Children of James Elburn Sr. and Elizabeth Covington, 3.1

James Sr. and Elizabeth Covington married on 12 Dec 1799. Elizabeth died between the 1830 and 1840 census records. Circumstantial evidence shows that James and Elizabeth had daughters Ann and Juliann using census records, location, and the time of their marriages, but none of these records shows the parents and daughtersÕ names together (as per Elaine Lecompte Rodney 15 Jul 2009).

4.1 Ann Elburn, b. ca. 1800 in MD, m. James D. Burdon on 16 Jan 1822 in Kent Co., MD. Census records indicate James D. Burdon/Burden was born in 1790. The 1810 census indicates she was born between 1800-1810. The 1820 census shows she was born 1795-1804. In the 1830 census, Ann was born 1801-1810. In the 1840 census, Ann was born b. 1801-1810. Neither James nor Ann can be found in the 1850 census. Their children moved to Indiana where AnnÕs brother James Jr. resided.

1820 census -- James Burden is listed in Election District 1, Kent Co., MD, age 26 thru 44 or born 1776-1794, living with his parents who were both over age 45, born before 1775. His father was engaged in manufacturing.

1820 census -- Election District 1, Kent Co., MD. Ann is living with her parents. See previous generation.

1822 Jan 16 -- James Burdon and Ann Elburn married in Kent Co., MD. The name has been spelled as Burdon, Burden, Burton, and Burten.

1825-1830 – son William Burdon was born. He may be the William Burton who shows on findagrave as born 1827 and died in 1902, married to Susannah, and buried at the Fork United Methodist Church Cemetery in Fork, Baltimore, MD.

1830 census* -- James Burdon appears of District 1, Kent Co., MD, age 40-49, born 1781-1790, living with a male age 70-80, 1750-1760, and a female age 80-90, 1740-1750, both of whom could have been the same couple (James BurdenÕs parents) as in the 1820 census. Apparently James D. Burden was counted twice, as he is also listed with his wife, Ann Elburn Burden in another record. This record has been verified from the original, as ancestry.comÕs original states that the two elderly Burdens were both aged 70-80.

1830 census* -- James D. Burden appears of District 1, Kent Co., MD, age 40-49, 1781-1790, living with 1 male under 5 (their son William), and James (probably the James married to Ann) was age 30-39 (b. 1791-1800) and Ann was age 20-29 (b. 1801-1810).

1840 census – Baltimore Ward 11, MD. James is listed as ÒJames D. BurdenÓ

Both Ann and James Burden seem to disappear by the 1850 census. The eldest son, William H. Burdon, was old enough to live on his own. His name has been recorded as the son of James and Ann Burdon. The 2 younger males are circumstantial evidence as far as their names are concerned; these males then lived with James Elburn Sr.

Son William H. Burdon cannot be found in the 1850 census.

1860 census – Son William H. Burdin was living in Brown, Montgomery, IN, age 38, b. 1822, with wife Mary A. Burdin, 26, and children: James A. Burdin 15, Harriet F. Burdin 12, Morw E. Burdin 6, Mary F. Burdin 4, Nathan L. Burdin 2.

1870 census – Son William Burdin was 48, b. 1822 MD, living in Tebo, Henry, Missouri, with wife Mary Burdin, 37, b. 1833, living with their children Mary I. Burdin 13, Francis Burdin 10, Clarissa Burdin 9, and Margaret Burdin 4.

1880 census -- Son William Burdin was supposed to have died in Indiana. The 1880 census of Union, Perry, IN, shows a W. H. Burdin, age 56, b. 1824 in Maryland, married to Mary A. Burdin, age 42, b. 1838 in MD, living with their 3 daughters all of whom were born in Indiana: F. L. Burdin 18; C. J. Burdin 16; M. E. Burdin 14. W. H. Burdin states that he and both his parents were born in Maryland. The oldest daughter was 18 and born in 1842; therefore, right after the 1840 census, they moved to Indiana.

 

4.2* James Elburn, Jr., b. 27 Feb 1804 in MD, m. Elizabeth Hague on 15 Nov 1826 in Kent Co., MD, and he d. 22 Dec 1871 in Wabash Co., IN, at age 67 years, 9 months, 25 days; his stone is broken into several pieces on the ground. Elizabeth Hague was b. 6 Jan 1805 and died 16 Jan 1873 in Wabash Co., IN, at age 68 years and 10 days. They were both buried at the Niconza Baptist Church Cemetery in Miami Co., IN. The Niconza Cemetery has 56 internments; 8 of them are Elburns: Barbara, Elizabeth, Indiana, James, James F., Reuben, Samuel, and William.

James Jr. probably moved to Indiana as most pioneers of the day did – the opportunity to acquire vast amounts of land at affordable prices, looking for the promise of a new start in a new land. He went west not long after the establishment of the Historic National Road, which originally ran from Cumberland, Maryland to Vandalia, Illinois. Brainchild of George Washington, it was built in an effort to populate the west, lure the pioneers to move and establish themselves. James Jr.Õs daughter Mary was born in Kent Co., MD, in 1829. The next child, Hester, was born in Indiana in 1839, so they moved sometime between the births of those two daughters.

Hague Family

Elizabeth Hague was the daughter of William Hynson Hague (1774-1834) and Hester Williamson (1780). She was born 6 Jan 1805 in Maryland and died 16 Jan 1873 in Wabash Co., IN, at age 68 years and 10 days. Her father wrote his will on 25 Mar 1832 in Kent Co., MD, which might indicate that Elizabeth had not yet moved to Indiana, but she appears in Indiana in the 1840 census. William Hague gives to his wife Hester, to his daughter Johanna Lazenby, to his daughter Elizabeth ÒElbournÓ, and to his daughter Sarah Hague. Because the signature part of his will is cut off, we donÕt know if he signed his name or made his mark with an ÒXÓ, but in any case, the name ÒElbournÓ is clearly spelled as such. The will was proved 18 Jun 1834.



Chronology

James and Elizabeth moved to Brookville, Franklin Co., IN, between 1832 and 1840. James paid U.S. IRS Tax Assessments on his property in 1864 in Indiana.

1830 census – James Elbourn, District 1, Kent Co., MD, with 11 (5 white and 6 colored) in the household and James is listed as age 20-29, and with ÒJr.Ó after his name. His father is listed separately as head of households in District 1, Kent Co., MD.

1838 – Family moved to Brookville, Franklin County, Indiana, probably for free land. Brookville was platted in 1808. They migrated west with several other families from Maryland.

4.3 Juliann Elburn, b. ca. 1808 in MD, m1. Thomas N. Legg on 11 Jan 1831 in Kent Co., MD. Thomas was from Baltimore, MD. He was in the Army in 1830-1835 and 1846-1847 and died 23 Jul 1847. She is listed in the 1810 census as born 1800-1810, in the 1820 census as born 1804-1810, in the 1830 census as born 1800-1810, in the 1840 census as born 1811-1820, and cannot be found in the 1850 census.

Juliann and Thomas had 2 children, an unnamed daughter, b. 1832-1840, and Thomas Legg Jr. b. 1843 (probably in between Thomas Legg Sr.Õs services in the US Army between 1830-1835 and 1846-1847; Thomas Legg Sr. died on 23 Jul 1847). Their son d. 7 Nov 1909 and is buried at the Mount Olivet Cemetery in Baltimore City, Maryland, along with his wife, Ellen L. Legg, who d. Apr 8, 1899.

Thomas N. Legg

Thomas N. Legg Sr. was born in 1806 in Baltimore, MD, listed on p. 109. His father may have been Benjamin Legg who is listed in the 1830 census of District 1, Kent, MD, age 50-59, with a son aged 20-29 who could have been Thomas. In this 1830 census, he was living in the neighborhood of James Burden, age 40-50, probably the father of James Burden Jr. who married JuliannÕs sister Ann. He was also living almost next door to Richard Legg who was age 20-30. He was also living near Josiah Ashley, Robert Legg, James D. Burden, and Silas Legg.

Thomas N. Legg Sr. enlisted in the U.S. Army on 7 Sep 1830 at the age of 24 in Rochester (not sure what state) under Capt. Clark; he had dark hair, dark eyes, fair complexion, 5Õ 7 ¼Ó in height, and was a carpenter, for 5 years in the 3rd Infantry G. until 7 Sep 1835 at his expiration of service at Fort Towson A. T., which was a frontier outpost for Frontier Army Quartermasters along the Permanent Indian Frontier located about 2 miles NE of the present community of Fort Towson, Oklahoma, at the southern border. The listing for Thomas below is in the middle row. Reference is from ancestry.com ÒU.S. Army Register of Enlistments, 1798-1914Ó. The record shows he did not die during this enlistment. He was born ca. 1806.

Thomas N. Legg enlisted at age 32 in 1846, determining he was born in 1814, somewhat younger than his wife Juliann Elburn. This document on p. 135 (last line) shows he has dark eyes, is 5Õ 8 ½Ó tall, born in Baltimore, Maryland, a carpenter, enlisted in the U.S. Army in Baltimore under Capt. Ker for 5 years and that he died during the Mexican War in Puebla, Mexico, on 23 Jul 1847 before completing his term. Reference is from ancestry.com ÒU.S. Army Register of Enlistments, 1798-1914Ó. The name ÒElburnÓ or variation does not appear in this document. Because of the different birth dates, 1806 and 1814, there is no proof that these men are the same other than their birthdates are the same, their occupation (carpenter), and their height is very similar. This record shows he died on 23 Jul 1847.

1840 census – Juliann Legg, District 1, Kent Co., MD, listed as ÒSuleanna LeggÓ in ancestry.com index, but her name appears as Julianna Legg (see below). Thomas Legg Sr. is not listed and he died 23 Jul 1947; he may have been away in the military during the 1840 census. Juliann marries after the census was taken in 1840. This census shows they had 2 children sometime during the very 5 years that Thomas was in the military.

Thomas Legg Jr. is listed in the 1850 census, age 22, born 1828 in MD, living in 1850 in District 2, Kent, MD, with James W. Greenwood, age 28, and Mary Iriford, age 40. The 1850 census is notorious for incorrect ages.

 

1840 Jul 13 -- Juliann m2. Thomas Berryman on 13 Jul 1840 in Kent Co., MD.

1844 – Julianna may have died about this time. Berryman children born between 1841-1844 in Baltimore, MD (not necessarily her children) are numerous and have no basis for being the children of this couple.

1844 Nov 1 – ÒList of LettersÓ remaining in the Baltimore Post Office and advertised in ÒThe SunÓ of Baltimore, MD.

1847 Jul 23 – Thomas Legg Sr. died in Puebla, Mexico during the Mexican War.

It seems all these relatives died before 1850, but they were all born about 1800:

4.4* George Henry Elburn, b. before Aug 1810, the 1810 enumeration date in Kent Co., MD, as he appears in the 1810 census, listed by age. He is listed as head of household in the 1840 census, but died before the 1850 census. A death records exists for ÒaÓ Henry Elborn who died in Apr 1850 before the 1850 census was taken, in Baltimore, MD, and he was born in 1810, but . . . he is a mulatto. As his son, George Washington Elburn, is listed as white, we are unsure of HenryÕs death record; it is kept in the Bibliography under [15].

Marriage

George Henry Elburn m. Rachel Porter ca. 1835 and she d. ca. 1841. They had one son, George Washington Elburn born 6 Dec 1830 – 14 May 1899. The sonÕs death record is the only record found giving the names of his parents, George Henry Elburn and Rachel Porter. The 1840 census is the only one where this couple appears together showing George as age 20-29 or born 1811-1820 and Rachel as 30-39 or born 1801-1810, indicating she was at few years older than he was. No other Elburns were in the household except these 3 in 1840. RachelÕs father may have been Joseph Porter Sr.

Porter Family

No proof whatsoever that Joseph Porter was related to Rachel Porter.

The 1783 Land Assessment Taxes of Kent, MD, list Joseph Porter in the 5th District who owns ÒJones NeglectÓ. Joseph Porter could have been RachelÕs father or grandfather. Joseph had to have been born in 1763 or before in order to own land. In the 1850 census, ÒaÓ Joseph Porter lives in Kent Co., and owns many slaves. ÒAÓ Joseph Porter appears in the 1790 census of Kent, MD.

In the 1810 census, Joseph Porter is listed as Jos Porter in Kent, MD, age 26-44, with 3 females under 10. He also has 1 male under 10 who would be age under 40 years old in the 1850 census.  

Maryland Militia in the War of 1812. Joseph Porter appears in the Maryland Militia in the War of 1812. In this same document on the War of 1812, James Elburn is listed, along with probably a brother of his, William, and his father, William. One William is listed on Aug 1813 under Capt. George Spry, William Elborn, 7 days, I would imagine he would be the father as he doesnÕt have a middle name. Then, William C. Elburn is listed on Sep 11-24, 1814, for 13 days. As these two Williams appear in different years, they could have been the same person.

Background Notes: No record of Rachel PorterÕs birth or death has been found. Her death was determined by the 1850 census where she would have been living with her son George Washington Elburn, and since her son is living with his grandfather in 1850, we can be assured that both George and Rachel had died by 1850.

1830 census -- Joseph is age 50-59 or born 1771-1760. His wife is still living. A female lives with him aged 20-29, which most probably is Rachel Porter, telling us that she didnÕt marry until after the 1830 census. Joseph now has 8 slaves and 1 free colored person, a male aged under 10 or born 1820-1830.

12 Apr 1836 – Joseph Porter Senior of Kent County, MD, received a summon to appear before the court in Chestertown on 10 May 1836 to testify the truth of his knowledge touching a certain matter of controversy in the court between Matthew Howard and wife (Sarah Ann Porter), administrator for Arthur Parsley and Noble Parsley. The summons apparently requiring his testimony concerning his daughter Sarah (Porter) Parsley Howard and her current husband Matthew Howard who were administrators of Sarah's former late husband Arthur Parsley's estate. Noble Parsley, also deceased, was Arthur Parsley's brother who died in 1832. Sarah Ann Porter married Arthur Parsley on 3 Aug 1824 in Kent, MD. She married Matthew Howard on 12 Oct 1833 in Kent, MD. Sarah was the daughter of Joseph Porter and Sarah Ashley who married on 20 Feb 1798 in Kent, MD.

Joseph Porter and Sarah Ashley had children John A. Porter, Joseph Porter, Mary Porter, Sarah Ann Porter, Rebecca Porter, and Henry A. Porter, but no Rachel Porter who is the person we are looking for who married George Henry Elburn. We are also looking for James A. Porter who married Henrietta Elburn. 1836 Apr 12 -- Arthur Parsley appears in the 1830 census of District 1, Kent, MD, age 40-49, born 1781-1790, with a family of 16. Neighbors are Silas Legg, James Burden, Richard Legg, Benjamin Legg, Robert Legg, James D. Burden, Mary Berryman, and James Elbourn Jr.    Noble Parsley died in Kent, MD before 1836; he is listed as the main beneficiary in the will of his brother Arthur Parsley, dated, 6 Mar 1833. He appoints Thomas Stephens his executor; no children are mentioned. It is signed by Noble Parsley.

The 1840 census of District 2, Kent, MD, of Joseph Porter shows only 3 people in the household, Joseph and his wife aged 40-49; this Joseph must have been JosephÕs son, also living with a male aged 5-9. This census shows us that Joseph Porter Sr. died between 1830 and 1840. No listing for Joseph Porter Sr. in findagrave.

1810 census – George Henry Elburn living with parents in Kent Co., MD, shown in this census as age under 5, but name is not given. Only circumstantial evidence.

1820 census George Henry Elburn lived with his parents in District 1, Kent Co., MD, b. 1805-1810. Census taken in August, therefore, George was born before August 1810, shown in this census by age only, not name. Only circumstantial evidence.

1830 census George Henry Elburn lived with his parents in District 1, Kent Co., MD, b. 1810-1815. Census taken in Aug 1830 when George was already 20, so George was born before Aug 1810. Shown in this census by age only, not name. According to the next census in 1840, only one woman of age to have married George is listed as born 1801-1810. In this 1830 census, the only applicable female listed who could have been GeorgeÕs wife Rachel Porter is listed as born 1810-1815. Therefore, combining these two census records, Rachel Porter was born in 1810.

1830 – George Henry Elburn m. Rachel Porter early in the year before the census was taken and had son George Washington Elburn on 6 Dec 1836 after the census was taken. This is very strange to have a child 6 years after marriage.

1840 census George Henry Elborn appears on p. 33 of 68 pages in District 2, Kent Co., MD, head of household, last page shows enumeration date of 26 Oct 1840, with a family of 5.

1 male under 5, b. 1836-26 Oct 1840, son George Washington Elburn. His death record indicates that his parents were Rachel Porter and George Henry Elborn. His age varies greatly from census to census.

1850 census – George Henry Elborn cannot be found. No record. There is a death record of a ÒHenry ElbornÓ in Apr 1850 in Baltimore, but no verification can be made that this was George Henry of this line.

1899 Mar 14 -- This document is the only one found so far with any information on it about George Henry Elburn, his wife Rachel Porter, and their son George Washington Elburn. Dropsy is an old term for edema, which is a condition characterized by an excess of watery fluid collecting in the cavities or tissues of the body. Using the Date Calculator, George Washington Elburn died on 14 Mar 1899 at 68 years 3 months and 8 days, which calculates to Monday, December 6, 1830. He had m1. Mary Crouch and m2. Mary Beck – perhaps the informant made a mistake with the surname as George was married at his death and he was married to Mary Beck.

 

4.5 Sarah Ann Elburn, b. ca. 1815, in Kent, MD. She is listed with James Elburn Sr. as though she was a daughter who never married. She seems to be the one who took care of many of the Elburn children when their parents died before the children were adults. Sarah was too young to marry by 1830 when her mother died and she became the matron of the household. She may have had son Lemuel Joseph Elbourn out of wedlock.

Average birthdate is 1815. These dates really vary too greatly to be one person. It's hard to say if these are 2 or 1 woman.

1840 census: female b. 1811-1820.

1850 census: female 34, b. 1816 - name Sarah

1860 census: female 49, b. 1811 - name Sarah

1870 census: female 50, b. 1820 - name Sarah

1880 census: Sarah cannot be found; she may have died.

1880 census -- There are only 59 women named Sarah (no last name) in this census in Kent Co., MD, born between 1805-1825. Changing the search parameters to born between 1810-1820, there are only 34 women with the name Sarah. None of these women fit Sarah A. Elburn; and therefore, she must have died and not remarried.

 

The ages of the children that Sarah took care of in the 1850 census are quite wide-spread and few parents of these children have been identified. We are investigating the possibility of William Elburn, supposedly the brother of James, b. ca. 1780, could have been the grandfather of either William or John Elburn, who died after perhaps having these children. William Elborn was in the War of 1812 with James, both of the Eastern Neck, MD. William is in the 1820 census with his wife and 2 males born 1810-1820, probably his sons. Because the last of these children, David, was born in 1846, we are looking for a male Elburn who died between 1846 and 1850 who had these children. That could be James Elburn Sr. who died in 1852 at age 83.

These children from the 1850 census are listed in the next generation living with James Elburn Sr., 81, b. 1769, and Sarah, 34, b. 1816, daughter of James Elburn Sr.

21 Lemuel, b. 1829, his father was not an Elburn/Elbourn, but his mother was probably an Elburn.
